The following terms have been designed to make sure that JustCY works for everyone. By accessing JustCY you are agreeing to be bound by these Terms and Conditions of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site.
2. Using JustCY
As a condition of your use of JustCY you agree that you will post in the appropriate category or area and you will not:
violate any laws;
violate the Posting Rules;
post any threatening, abusive, defamatory, obscene or indecent material;
be false or misleading;
infringe any third-party right;
distribute or contain spam, chain letters, or pyramid schemes;
distribute viruses or any other technologies that may harm JustCY or the interests or property of JustCY users;
impose an unreasonable load on our infrastructure or interfere with the proper working of JustCY;
copy, modify, or distribute any other person's content without their consent;
use any robot spider, scraper or other automated means to access JustCY and collect content for any purpose without our express written permission;
harvest or otherwise collect information about others, including email addresses, without their consent;
bypass measures used to prevent or restrict access to JustCY.
You are solely responsible for all information that you submit to JustCY and any consequences that may result from your post. We reserve the right at our discretion to refuse or delete content that we believe is inappropriate or breeching the above terms. We also reserve the right at our discretion to restrict a user's usage of the site either temporarily or permanently, or refuse a user's registration. If you post on JustCY and are not complying with any of the above mentioned rules or provide false contact details or are impersonating another party we reserve the right to pass your details and IP address on to the aggrieved third party, their agents or any law enforcement agency.
3. Abusing JustCY
JustCY and the JustCY community work together to keep the site working properly and the community safe. Please report problems, offensive content and policy breaches to us using the information provided on our Contact Us page.
Without limiting other remedies, we may issue warnings, limit or terminate our service, remove hosted content and take technical and legal steps to keep users off JustCY if we think that they are creating problems or acting inconsistently with the letter or spirit of our policies. However, whether we decide to take any of these steps, remove hosted content or keep a user off JustCY or not, we do not accept any liability for monitoring JustCY or for unauthorized or unlawful content on JustCY or use of JustCY by users.
4. Fees and Services
JustCY is generally free, but may charge a fee to post content or for other features, products, services or licenses. You are responsible to JustCY for any fees applicable to content that you post or other features, products, services or licenses you purchase or that are purchased through your account. You authorize JustCY, or its designated payment processor, to charge your specified credit card, debit card or other payment method for such fees.
Unless otherwise specified, all fees are in Euros and all charges will be made in Euros. Currency exchange settlements and foreign transaction fees are based on your agreement with your credit card or other payment method provider.
We may choose to temporarily change our fees for promotional events or new services; these changes are effective when we announce the promotional event or new service.
Except as required by law, all fees are non-refundable, including, without limitation, in situations where paid posts are removed by JustCY or by community flagging. Payments and purchases may not be cancelled by the user, except as required by law. However, JustCY reserves the right to refuse or terminate any purchase or attempted purchase at any time in its sole discretion. You understand and agree that if you authorize a payment transaction with your credit card, debit card or other payment method, but your charge is rejected for any reason, there may be a hold on your use of that transaction amount for several days.
JustCY contains content from us, you, and other users. JustCY is protected by copyright laws and international treaties. Content displayed on or via JustCY is protected as a collective work and/or compilation, pursuant to copyrights laws and international conventions.
The content on JustCY is provided "AS IS" and on an "IS AVAILABLE" basis without any representations or any kind of warranty made (whether express or implied by law) to the extent permitted by law, including the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy. Further, JustCY does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the content on its Internet web site.
You agree not to copy, distribute or modify content from JustCY without our express written consent. You may not disassemble or decompile, reverse engineer or otherwise attempt to discover any source code contained in JustCY. Without limiting the foregoing, you agree not to reproduce, copy, sell, resell, or exploit for any purposes any aspect of JustCY (other than your own content). When you give us content, you are granting us and representing that you have the right to grant us, a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable right to exercise the copyright, publicity, and database rights to that content.
Nothing in these terms shall limit our liability for fraudulent misrepresentation, for death or personal injury resulting from our negligence or the negligence of our agents or employees. You agree not to hold us responsible for things other users post or do.
We do not review users' postings and are not involved in the actual transactions between users. As most of the content on JustCY comes from other users, we do not guarantee the accuracy of postings or user communications or the quality, safety, or legality of what's offered.
In no event do we accept liability of any description for the posting of any unlawful, threatening, abusive, defamatory, obscene or indecent information, or material of any kind which violates or infringes upon the rights of any other person, including without limitation any transmissions constituting or encouraging conduct that would constitute a criminal offence, give rise to civil liability or otherwise violate any applicable law.
We cannot guarantee continuous, error-free or secure access to our services or that defects in the service will be corrected. While we will use reasonable efforts to maintain an uninterrupted service, we cannot guarantee this and we do not give any promises or warranties (whether express or implied) about the availability of our services.
Accordingly, to the extent legally permitted we expressly disclaim all warranties, representations and conditions, express or implied, including those of quality, merchantability, merchantable quality, durability, fitness for a particular purpose and those arising by statute, even if JustCY or a JustCY authorized representative has been notified orally or in writing of the possibility of such damage. We are not liable for any loss, whether of money (including profit), goodwill, or reputation, or any special, indirect, or consequential damages arising out of your use of JustCY, even if you advise us or we could reasonably foresee the possibility of any such damage occurring. Some jurisdictions do not allow the disclaimer of warranties or exclusion of damages, so such disclaimers and exclusions may not apply to you.
Despite the previous paragraph, if we are found to be liable, our liability to you or any third party (whether in contract, tort, negligence, strict liability in tort, by statute or otherwise) is limited to the greater of (a) the total fees you pay to us in the 12 months prior to the action giving rise to liability, and (b) 100 Euros.

If a dispute arises between you and JustCY, we strongly encourage you to first contact us directly to seek a resolution by going to the JustCY Contact Us page. We will consider reasonable requests to resolve the dispute through alternative dispute resolution procedures, such as mediation or arbitration, as alternatives to litigation.
9. Revisions and Errata
The content appearing on JustCY could include technical, typographical, or photographic errors. JustCY does not warrant that any of the content on its web site is accurate, complete, or current. JustCY may make changes to the materials contained on its web site at any time without notice. JustCY does not, however, make any commitment to update the content.
JustCY has not reviewed all of the sites linked to its Internet web site and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by JustCY of the site. Use of any such linked web site is at the user's own risk.
We may update this agreement at any time, with updates taking effect when you next post or 30 days after we post the updated policy on the site, whichever is sooner. By using this web site you are agreeing to be bound by the then current version of these Terms and Conditions of Use.
12. Governing Law
This Agreement shall be governed and construed in all respects by the laws of the Republic of Cyprus. You agree that any claim or dispute you may have against JustCY must be resolved by the courts of the Republic of Cyprus. You and JustCY both agree to submit to the exclusive jurisdiction of the Republic of Cyprus Courts.
If we don't enforce any particular provision, we are not waiving our right to do so later. If a court strikes down any of these terms, the remaining terms will survive. We may automatically assign this agreement in our sole discretion in accordance with the notice provision below.
These terms and conditions constitute the entire agreement between you and JustCY and supersede any prior written or oral agreement. Other than the JustCY Representatives (who are expressly included as named third-party beneficiaries of the terms and conditions), there are no third-party beneficiaries to the terms and conditions.
We are committed to conducting our business in accordance with these principles in order to ensure that the confidentiality of personal information is protected and maintained.
